Scope of Coverage The Defense Base Act, like other workers’ compensation legislation is designed to assure that an injured employee is provided prompt compensation for injuries or illnesses arising out of and in the course of the employment. As with most workers’ compensation legislation, the Defense Base Act is constructed and enforced so that the interests of the injured employee are paramount in the claims adjudication process. While it is not correct to state that the Defense Base Act provides “24 hour coverage”, it is true that the Act, and the case law that has developed from it, clearly recognize the wide variety of circumstances that may arise out of overseas employment and thus the scope of the Act’s coverage is much broader than that of most State workers’ compensation legislation. Each case must be evaluated on its own merits in line with the specifics of the Act itself and the prevailing case law. Employers Covered by the Defense Base Act Section 1 of the Defense Base Act enumerates where and when the Act applies. In simpler terms the Defense Base Act is applicable to employers who are performing work outside the United States for the benefit of the United States or its allies and funded, in whole or in part, explicitly or implicitly, by the US Government or any executive department or agency thereof. Employees Covered by the Defense Base Act By definition all employees working on the contract are entitled to benefits under the Defense Base Act regardless of nationality. However it is possible to obtain a waiver of Defense Base Act coverage for non-United States citizens/residents/hires under certain circumstances. Defense Base Act Benefits The Defense Base Act may provide the following types of benefits to employees whose deaths, injuries or occupational illnesses arise out of, and in the course of their employment: 1. Medical Services and Supplies payable to Maximum Medical Improvement (MMI). 2. Temporary Total Disability (TTD). 3. Temporary Partial Disability (TPD). 4. Permanent Partial Disability (PPD). 5. Permanent Total Disability (PTD). 6. Death Benefits. 7. Funeral Benefits. |

We are in the process to tailor an insurance policy to cover loss, damage or expense that may arise as a result of non-appearance of an insured person and/ or the cancellation of an event due to named perils. This insurance is intended to protect the interest of the insured for pre-organized and scheduled events whereas as a result, for example, of a National Mourning in the country a grand celebration with a high prominent singer is to appear but due to the government declared mourning the event is cancelled, the insurance will indemnify the insured for amounts as agreed and declared. The insurance would also cover the cost and expense incurred due the cancellation in case of damage to or destruction of the venue at which the insured performance(s) or event(s) is (are) to take place. We are to endeavor all efforts to provide a well tailored insurance cover to protect the insured in respect of celebrations to take place at Christmas or New Year or any other occasion. |
